This page is maintained by Pure Golf, LLC to explain the rules and responsibilities for using the PARAGON Golf website, apps, and related services (the “Services”). It is not legal advice; consult a qualified attorney if you have questions.
1. Acceptance of Terms
By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Services.
2. About Our Services
PARAGON Golf provides an on-course ordering and delivery platform that connects golfers with participating golf courses. We are a technology service provider, not a restaurant, merchant, or seller of food, beverages, or other goods. The course operator is responsible for the products it offers, order fulfillment, quality, and applicable taxes and fees.
3. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Services. By using PARAGON Golf, you represent that you meet these requirements.
4. Accounts & Security
You may be asked to create an account or provide contact information. Keep your account credentials secure, and notify us immediately of any unauthorized use. You are responsible for all activity under your account.
5. Orders & Payment
Payments are processed by our PCI-compliant payment processor, Stripe. PARAGON Golf does not store full payment card details. You agree to pay all amounts owed for orders placed through your account, including tips and any applicable taxes or fees.
6. Cancellations, Refunds & Disputes
Cancellation, refund, and order-dispute policies are set by the participating course operator. If you have an issue with an order, please contact the course directly or reach out to us at support@paragongolf.co and we will help route your request.
7. Prohibited Conduct
You may not use the Services for any unlawful purpose, interfere with our systems, submit false information, harass staff or other users, or resell access to the Services. We may suspend or terminate access for violations.
8. Intellectual Property
The PARAGON name, logos, designs, software, and content are owned by Pure Golf, LLC or its licensors and are protected by intellectual property laws. You may not copy, modify, or use them without permission.
9. Disclaimers & Limitation of Liability
The Services are provided “as is” without warranties of any kind, except where prohibited by law. Pure Golf, LLC is not liable for indirect, incidental, special, or consequential damages arising from your use of the Services. Our total liability will not exceed the amount you paid for the specific order or use giving rise to the claim.
10. Indemnification
You agree to indemnify and hold harmless Pure Golf, LLC, its affiliates, officers, and employees from claims arising out of your use of the Services, your orders, or your violation of these Terms.
11. Governing Law
These Terms are governed by the laws of the State of Montana, without regard to conflict-of-law principles. Any disputes will be resolved in the courts located in Kalispell, Montana.
12. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on this page with a revised date. Continued use of the Services after changes means you accept the new Terms.
